User registration and service agreement for IoTBus cloud

INTRODUCTION

Welcome to use IoTBus cloud software and service!

For the use of the Software and Service (the following referred to as "the Service"), you should read and comply with《User registration and service agreement for IoTBus cloud》(the following referred to as "the Agreement"). Please read carefully and fully understand the contents of each term, especially the exclusion or restriction of liability terms, and open or use a separate agreement for a service, choose to accept or not accept it. Restrictions and exclusion terms may prompt you in bold form.

You have no right to download, install or use the Software and related services unless you have read and accepted all the terms of this Agreement. Your download, installation, use, access to machine code, login and other acts show that you have read and agreed to the above agreement.

一、The scope of the agreement

1.1 The scope of the agreement applies to the subject

This Agreement is an agreement between you and IoTBus regarding your download, installation, use of the Software, and other related services.

1.2 Agreement relationship and conflict terms

The contents of this agreement include the relevant information, business rules and so on regarding the possible release of the service. The above information, once officially released, is an integral part of this Agreement, you should also comply.

二、About this service

2.1 The contents of this service

The service content refers to IoTBus provide users with cross-platform remote access to industrial equipment, remote monitoring software and services to support single or multi-person participation, based on the provision of basic services such as remote monitoring of industrial equipment for cross-platform, it also provides users with functions including but not limited to instant messaging, alarm early warning, chain extension, convenience tools, access management, email management, open platform Or content of the software license and services.

2.2 The form of this service

2.2.1 You need to download IoTBus cloud APP software. For this software, you may only use the software and service for the purpose of accessing or using the service.

2.2.2 This service is provided by IoTBus company, including but not limited to iOS, Android and other application versions, the user must install the software version to match the terminal device.iOS、Android、Windows Phone、Symbian、BlackBerry、Windows、Mac

2.3 The scope of this service license

2.3.1 You can install, use, display, and run the software on a single terminal device.

2.3.2 All other rights not expressly authorized by this term and other terms of this Agreement are retained by IoTBus company, you shall obtain writing permission from IoTBus company when you exercise of those rights. If IoTBus does not exercise any of the rights mentioned above, it does not constitute a waiver of that right.

三、Software acquisition

3.1 You can obtain the software directly from IoTBus official website at: http://www.iotbus.net, or you can get it from an authorized third party.

3.2 If you obtain this software or the installation program which has the same name as IoTBus cloud software from a third party that is not authorized by IoTBus, IoTBus can not guarantee that the software will be used normally and will not be responsible for any loss caused to you.

四、Software installation and uninstallation

4.1 IoTBus maybe develop different software version for different terminal equipment, you should download and install the appropriate version according to the actual situation.

4.2 After downloading installation program, you need to follow the steps suggested by the program to install correctly.

4.3 To provide a higher quality and secure service, at the time of software installation, it is possible to recommend you install other softwares that you can choose to install or not install.

4.4 If you no longer need to use the software or need to install the new version of software, you can uninstall. If you are willing to help IoTBus to improve the product service, please inform the reasons for uninstall.

五、Software updates

5.1 In order to improve the user experience and service content, IoTBus will continue to develop new services and provide you with software updates from time to time (these updates may take the form of software replacement, modification, feature enhancement, version upgrade and so on).

5.2 In order to ensure the safety and functional consistency of the software and services, IoTBus has the right to update the software without any special notice to you, or to change or restrict the functional effects of the software.

5.3 After the new version of software is released, the older versions of software may not be available. Please do not hesitate to check and download the latest version of software, because IoTBus does not guarantee that the old version of software and corresponding customer service continue to be available.

六、User personal information protection

6.1 Protecting the user's personal information is a basic principle for IoTBus, and IoTBus will take reasonable measures to protect the user's personal information. Except the circumstances prescribed by laws and regulations, without the user permission, IoTBus will not disclose the user's personal information to third party. As for the relevant information, IoTBus use professional encryption storage and transmission methods to protect the user's personal information security.

6.2 You need to provide some necessary information when register account or use the service, such as: provide you with account registration service or user identification, you need to fill in the mobile phone number or email address; mobile phone address matching function requires your authorization to access mobile phone contacts and so on. If the national laws and regulations or policies have special provisions, you need to provide real identity information. If the information you provide is incomplete, you will not be able to use the service or be restricted during using.

6.3 In general, you may browse and modify your own information at any time, but you may not be able to modify the initial registration information and other verification information provided at the time of registration for security and identification purposes (such as retrieving an account service).

6.4 IoTBus will use a variety of safety techniques and procedures to establish a sound management system which can protect your personal information from unauthorized access, use or disclosure.

6.5 Without your consent, IoTBus will not disclose your personal information to any company, organization and individual outside IoTBus.

七、Main rights and obligations terms

7.1 Account usage specification

7.1.1 You need to register a IoTBus cloud account before using the service. IoTBus cloud account can be registered by phone number or email address, and after registration is successful, you can use the functions and services provided by IoTBus cloud.

7.1.2 Ownership is owned by IoTBus company. After the user completes the application for registration, the user only obtains the right to use the service for IoTBus cloud, and the right of use only belongs to the initial application registrant.

7.1.3 User have the responsibility to keep the registered account information and account password security. The user is required to take legal responsibility for the behavior under registered acouunt and password. The user agrees not to disclose account and password information to others in any case. When you suspect that someone else is using your account, you can reset the password to prevent the use of others, or immediately notify IoTBus company.

7.2 User notes

7.2.1 You should understand and agree that in order to provide you with effective service, the software will use your terminal equipment, such as processor and bandwidth resources. It is possible to produce data traffic costs during using software, so users need to understand the relevant charges information from operator, and bear the relevant costs.

7.2.2 You should understand and agree that certain features of the software may cause third parties to know the user's information, such as the owner of the device, the administrator, the visitor can view the details of the device and the member information corresponding to the device and so on.

7.2.3 When you use this software for a particular service, the service may have separate agreements, related business rules and so on (the following are collectively referred to as "separate agreements"), before you use this service, please read and agree to the relevant separate agreements; you use the specific service mentioned above, that is, you accept the relevant separate agreements.

7.2.4 You should understand and agree that IoTBus will endeavor to make every effort to ensure that your data and storage in the software and services are safe, but IoTBus does not provide full assurance, including but not limited to the following cases:

7.2.4.1 IoTBus is not responsible for your failure to delete or store the relevant data in the software and services.

7.2.4.2 IoTBus has the right to determine the maximum storage period for individual users in the software and services in accordance with the actual situation, and allocates the maximum storage space for data on the server.

7.2.4.3 If you stop using the software and services or services are terminated or canceled, IoTBus can permanently delete your data from the server. After the service has stopped, terminated or canceled, IoTBus is not obliged to return any data to you.

7.2.5 Users are responsible for the following risks which IoTBus can not control arising from the use of the Software and Services, including but not limited to:

7.2.5.1 Due to irresistible factors may cause personal information loss, leakage and other risks;

7.2.5.2 The user must select the software version that matches the installed terminal equipment. Otherwise, any problems or damage caused by the mismatch between the software and terminal equipment model, shall be borne by user;

7.2.5.3 When the user accesses the device by using the software, the risk which the device may cause should be borne by the user;

7.2.5.4 When the users accesses, if there are multi-user simultaneous access, may bring risks and responsibilities.

7.2.5.5 Because of the instability of the wireless network signal and the small bandwidth of the wireless network, which cause the login failure, the incomplete data synchronization and the slow speed of the page opening and other risks.

7.3 Third party products and services

7.3.1 When you use the products or services provided by the third party of this software, you should abide the user agreement of third party in addition to the terms of this agreement. IoTBus and the third party are liable for possible disputes within the limits of the law and the agreement.

八、Regulation of user’s behavior.

8.1 Information regulation.

8.1.1 The information referred in this clause means the contents when user use this software , except for the account icon, user, name, user instruction etc.

8.1.2 When using the IoTBus’s could account or software, You understand and agree not to disturb the running of IoTBus company, or to infringe other user and third party’s proper right. And not allow to access other legal users’ devices or content.

8.2 Regulation of software use

8.2.1 Except for complying with the law or getting the paper permission from IoTBus, You are not allow to behave bellow actions when using this software:

8.2.2 Base on the factors of user experience, relevant servant platform running, rules regulating, or healthy development, You understand and agree, IoTBus have the privilege to chose his serve object, decide his function setting , his open characteristic, data interface and relevant data for serving the object within range. IoTBus also have the privilege to pause or terminate this serve when come to (but not limit to ) bellow occasions

8.2.2.1 When break the law or this agreement

8.2.2.2 When have impact on serving experience

8.2.2.3 When there is uncertain safety risk exist;

8.2.2.4 When operation interface, style, function, discription or user experience similar to IoTBus APP or other serve platform, which may cause the misunderstand that user is using service from IoTBus or authority from IoTBus.

8.3 Serve regulation

Except for complying with the law or getting paper permission from IoTBus, You are not allow to break the law or administrative decrees, infringe other user’s legal right, disturb the normal running of IoTBus and behave action out of obvious allow.

8.4 Responsible for yourself action

You fully understand that, You are the one who would responsible for any consequences due to your every action once you register account and use this soft. You should judge the content of this software by yourself and afford all the risk due to your rely on the lack of content correctness , completeness or practicability. IoTBus is free from the liability of before-mentioned loss and damage.

8.5 Dispose of default

8.5.1 When found or received any report from others about breaking this agreement, IoTBus keep the right to (not limit to) warning, limited or suspend some parts (or all) functions, account suspend or even cancellation punishment, then announce processing results.

8.5.2 Your agree and understand, IoTBus have the right to conduct punishment who break relevant laws, regulations or the provisions of this agreement on ground of reasonable judge. User should responsible for any law consequence when break relevant legal provisions. IoTBus have the right to take care of relevant evidence or information and report to relevant department.

8.5.3 You understand and agree, You are responsible for the third party declaim, request for loss due to the violation of the this agreement or relevant term of serve. Including to the loss due to user’s behaviors.

九、Intellectual property declaration

9.1 IoTBus is the intellectual property owner of this software. All intellectual property including copyright, Trademark right, patent right , commercial secret concerned to this software, all information mentioned (including the words, pictures, graphic, structure, data and electrical files etc ), are bounds to the People's Republic of China’s laws and regulations and relevant international treaties. IoTBus company own its intellectual property, except for some privilliages that authorized by law to relevant person according to the law.

9.2 Without any permission in paper of IoTBus or relevant person in law, you are not allow the third party to excute, exploit, or transfer the above intellectual property

十、Safty liability of terminal

10.1 You should agree and understand, like most of other internet software, this software can be affected by lots of factors, including but not limited to user reason, network quality, social environment etc; It may have all kinds of intrusion, including but not limited to be illegal used to remote control industrial device, manipulate industrial device with user’s information; Viruses, trojan program or other malicious programs may contain in the software you download or websites you visit. All these will be a threat to the safty of your device and data, and even affect this software’s use. Therefore, you should strengthen the awareness of information security and personal information protection, keep pass code well saved to avoid loss.

10.2 You and IoTBus have the liability to protect this software and make it run normally. IoTBus will cautionly take necessary protecting measure to protect your terminal device and data in line with industrial standards . But you confess and agree that IoTBus can not give full guarantee.

十一、Third party software or technology

11.1 This software may use third party software and technology (including the open sourcing code or public code etc. Same as below), this application have gained the legal authority.

11.2 If the third party software or technology are applied in this software, the relevant protocols or other files would be packed into certain file folder, or exhibit in open source software page by IoTBus according to relevant law or agreement. They can be named as “ software license agreement”, “Authorize agreement”, ”Open source code license” or other terms of description. Before-mentioned relevant agreement, other files and web page are inseparable parts to this agreement, and share equal authentic.

11.3 Any dispute cause by third party software or technology when use this software, IoTBus have no liability. Also IoTBus don’t provide customer service for third party software and technology. If you need this, please contact the third party.

十二、Others

12.1 If you use this software, it is deemed that you have read and agree to be bound by this agreement. IoTBus keep the right to modify this agreement at necessary time. You can access the latest version software for this agreement terms. If you continue to use the software after the agreement terms changed, it is deemed that you have accepted the amended agreement. You should stop using this software if you don’t accept the modify terms of this agreement.

12.2 This address of signing this agreement is at Xiangan district , Xiamen City, Fujian provice of P.R.C.

12.3 The establishment, entry into force, performance, interpretation and settlement of this Agreement shall be governed by the laws of the mainland of the People's Republic of China.

12.4 Friendly negotiation is the first step if there is any conflit or dispute between you and IoTBus. If it come to no end, you agree to submit the dispute to the jurisdiction court under the signing address of this Agreement.

12.5 The term title of agreement only for convenient read, itself dosen’t have practical mean which use as explaination for other occasion.

12.6 For any reason, any invalid or inexecutable term of this agreement would have no effect on other terms. (End of text)
